Terms and conditions for booking our landscaping services

This Online Booking Policy outlines the terms and conditions for booking consultations, quotes, and landscaping services with Kowski Construction through our website, phone, or email. By submitting a booking request, you agree to these terms.

1. Booking Process

1.1 Quote Requests

When you submit a quote request through our online form, phone, or email:

  • We will contact you within 24 business hours (Monday-Saturday, excluding holidays)
  • A brief phone consultation will be conducted to discuss your project needs
  • If appropriate, we will schedule a free on-site consultation
  • A detailed written quote will be provided within 3-7 business days of the site visit

1.2 Consultation Booking

Free consultations are available for projects within our service area (Calgary and surrounding areas up to 50km). To book a consultation:

  • Complete the online booking form or call us directly
  • Provide accurate contact information and property address
  • Describe your project scope and timeline
  • Select preferred consultation dates and times

Consultation Fees

Within Calgary & immediate surrounding areas: FREE

Outside standard service area (50km+ from Calgary): Travel fee may apply ($50-$100 depending on distance). This fee will be communicated before scheduling and can be credited toward your project if you proceed with our services.

1.3 Project Booking

Once you accept our quote, to secure your project booking:

  • Review and sign the project contract/agreement
  • Pay the required deposit (typically 30-50% of total project cost)
  • Confirm your preferred start date and timeline
  • Provide site access details and any special instructions

2. Deposits and Payment

2.1 Deposit Requirements

To secure a booking and reserve materials, a deposit is required:

  • Small projects (Under $5,000): 30% deposit
  • Medium projects ($5,000-$15,000): 40% deposit
  • Large projects ($15,000+): 50% deposit

2.2 Accepted Payment Methods

  • Credit/Debit Cards (Visa, Mastercard, Amex) - 2.5% processing fee applies
  • Electronic bank transfer (e-transfer) - No fee
  • Company cheque
  • Cash

2.3 Payment Schedule

Standard payment structure:

  • Deposit: Due upon contract signing
  • Progress payment: 25-40% due at project midpoint or upon material delivery
  • Final payment: Remaining balance due upon project completion and your approval

3. Scheduling and Timeline

3.1 Project Start Dates

Project start dates are estimated based on:

  • Current project schedule and availability
  • Weather conditions and seasonal factors
  • Material availability and lead times
  • Required permits and approvals

We will provide you with a confirmed start date once all booking requirements are met and conditions are favorable.

3.2 Project Duration

Estimated project timelines are provided in your quote. Actual duration may vary due to:

  • Weather delays
  • Unforeseen site conditions
  • Changes to project scope
  • Material delivery delays

3.3 Weather-Related Delays

Landscaping work is weather-dependent. We may need to postpone work due to:

  • Heavy rain or snow
  • Extreme temperatures (below -10째C or above 35째C)
  • High winds
  • Muddy or frozen ground conditions

No penalties or fees apply for weather-related delays by either party.

4. Cancellation Policy

4.1 Client Cancellations - Before Work Begins

More than 14 days before start date:

  • Full refund of deposit minus $250 administrative fee
  • If custom materials have been ordered, material costs will be deducted from refund

7-14 days before start date:

  • 50% of deposit refunded
  • Material costs deducted if already ordered

Less than 7 days before start date:

  • No refund of deposit
  • Deposit may be applied to rescheduling if done within 60 days

4.2 Client Cancellations - After Work Begins

If you cancel after work has started:

  • Full payment for completed work is due
  • Payment for materials already purchased/delivered
  • No refund on deposit
  • Site restoration to safe condition (if required) will be billed at cost

4.3 Kowski Construction Cancellations

We reserve the right to cancel a booking if:

  • Site conditions make work unsafe or impossible
  • Required permits cannot be obtained
  • Client fails to provide site access
  • Payment obligations are not met
  • Client behavior is abusive or threatening to our staff

In case of cancellation by Kowski Construction, full refund of all deposits will be issued within 7 business days.

5. Rescheduling Policy

5.1 Client-Initiated Rescheduling

More than 7 days notice:

  • One free reschedule allowed
  • Additional reschedules: $150 rescheduling fee
  • New start date subject to availability

Less than 7 days notice:

  • $250 rescheduling fee applies
  • If materials already ordered, storage fees may apply ($50/week)

5.2 Kowski Construction Rescheduling

If we need to reschedule due to weather, equipment issues, or other factors:

  • No fees or penalties apply to the client
  • We will provide at least 24 hours notice when possible
  • Priority rescheduling will be offered
  • If rescheduling causes unacceptable delays, full refund is available

6. Site Access and Preparation

6.1 Client Responsibilities

Before the scheduled start date, clients must:

  • Ensure clear access to work areas for equipment and crew
  • Mark locations of underground utilities, irrigation lines, and septic systems
  • Remove or protect personal items, outdoor furniture, and decorations
  • Secure pets indoors or away from work areas
  • Arrange for parking if driveway access is needed
  • Inform neighbors of scheduled work (if applicable)
  • Obtain any required HOA or condo board approvals

6.2 Access Requirements

For work to proceed, we require:

  • Minimum 3-foot wide access to backyard (if rear work is planned)
  • Clear path for equipment and material delivery
  • Access to water and electricity (if needed for project)
  • Ability to park work vehicles on-street or in driveway

Important: Utility Locates

It is the client's responsibility to contact Alberta One-Call (1-800-242-3447) at least 3 business days before the start date to have underground utilities marked. Failure to do so may result in project delays and additional costs.

Kowski Construction is not responsible for damage to unmarked utilities.

7. Changes to Project Scope

7.1 Client-Requested Changes

If you wish to make changes after booking:

  • Before work begins: Minor changes may be accommodated at no extra charge; significant changes require a new quote
  • During work: Change orders must be submitted in writing; additional costs will be quoted and approved before proceeding
  • Changes may affect project timeline

7.2 Site Condition Changes

If unexpected site conditions are discovered (rock, poor soil, drainage issues, etc.):

  • Work will be paused to discuss options
  • A revised quote will be provided for additional work
  • Client approval required before proceeding
  • No obligation to proceed with additional work

8. Permits and Approvals

8.1 Who Obtains Permits?

Unless otherwise specified in your contract:

  • City of Calgary permits: Kowski Construction will obtain and pay for (cost included in quote)
  • HOA/Condo approvals: Client's responsibility to obtain
  • Neighbor agreements: Client's responsibility (if required)

8.2 Permit Delays

If permit approval is delayed beyond our control, project start dates may be adjusted accordingly without penalty to either party.

9. Seasonal Booking Considerations

9.1 Peak Season (April - October)

  • Booking demand is highest
  • Book 4-8 weeks in advance recommended
  • Limited availability for rush projects
  • Premium rates may apply for expedited scheduling

9.2 Off-Season (November - March)

  • Reduced activity due to weather
  • Some services not available (sod installation, concrete work)
  • Winter discounts may be available for spring bookings
  • Planning and design services available year-round

10. Communication and Updates

10.1 Project Updates

During your project, you can expect:

  • Confirmation call/email 24-48 hours before start date
  • Daily updates for multi-day projects (via text, email, or phone)
  • Photos of progress (upon request)
  • Immediate notification of any issues or required changes

11. Completion and Final Inspection

11.1 Project Completion

Upon completion:

  • We will notify you that work is complete
  • A walkthrough will be scheduled for your inspection
  • Any concerns will be addressed promptly
  • Final payment is due upon your approval
  • Maintenance instructions will be provided

11.2 Final Walkthrough

During the final walkthrough, we will:

  • Review all completed work
  • Address any questions or concerns
  • Provide care and maintenance instructions
  • Collect final payment
  • Provide warranty documentation

12. Warranty Coverage

All booked projects include:

  • Workmanship warranty: 1 year from completion date
  • Material warranties: As provided by manufacturers
  • Plant material: Separate warranty terms (typically 30-90 days)

Warranty claims must be submitted in writing within the warranty period. For full warranty details, see your project contract.

13. Booking Disputes

If you have concerns about your booking or project:

  1. Contact us directly to discuss - most issues can be resolved through communication
  2. Submit concerns in writing via email
  3. Request a meeting with project manager or owner
  4. If unresolved, refer to dispute resolution terms in our Terms of Service

14. Changes to This Policy

We may update this Booking Policy from time to time. Changes will be effective immediately upon posting to our website. Your continued booking of services after changes constitutes acceptance of the updated policy.
